1. What Downshift Is

Downshift is a mobile wellness application designed for truck drivers. It provides mood tracking, guided exercises, sleep sounds, journaling, health tracking, and crisis resource access.

2. What Downshift Is Not

Downshift is not a medical device, a therapy service, or a substitute for professional mental health care. It is a self-help wellness tool. If you are experiencing a mental health crisis, call 988 (Suicide & Crisis Lifeline) or text HOME to 741741 (Crisis Text Line).

The health information provided in the app (statistics, nudges, tips) is for educational purposes only and should not be considered medical advice.

3. Your Account

• You must be at least 13 years old to create an account
• You are responsible for keeping your login credentials secure
• You may only create one account per person
• You can delete your account at any time from the Profile screen, which permanently removes all your data

4. Your Data

You own your data. We store it to provide the app's features. See our Privacy Policy for full details on what we collect, how we use it, and your rights.

By using the app, you grant us permission to store and process your data as described in the Privacy Policy.

5. Acceptable Use

You agree not to:

• Use the app for any illegal purpose
• Attempt to access other users' data
• Reverse-engineer, decompile, or tamper with the app
• Use automated tools to access the app (bots, scrapers)
• Attempt to overload the service (denial of service)

6. The App May Change

We may add, modify, or remove features at any time. We may introduce paid features in the future (see section 7). We will try to give reasonable notice for significant changes.

7. Pricing

Downshift is currently free during early access. We may introduce a paid tier ("Downshift Pro") in the future. If we do:

• Core mental health and crisis features will always remain free
• We will give advance notice before any pricing changes
• Early access users may receive discounted pricing
• You will never be charged without explicit consent

8. Disclaimer of Warranties

The app is provided "as is" without warranty of any kind. We do not guarantee that the app will be available at all times, free of errors, or suitable for any particular purpose.

We are not responsible for decisions you make based on information in the app. The mood tracking, health nudges, and fatigue warnings are informational tools — not professional advice.

9. Limitation of Liability

To the maximum extent permitted by law, Downshift and its creators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app.

This includes, but is not limited to, damages related to health decisions made based on app content, data loss, or service interruptions.

10. Crisis Resources

The crisis phone numbers and text lines provided in the app (988, 741741, etc.) are operated by third parties. We provide them as a convenience and are not responsible for those services. If those numbers change, we will update the app as soon as possible.

11. Termination

You may stop using the app and delete your account at any time. We may terminate or suspend your account if you violate these terms.

12. Changes to These Terms

We may update these terms. If we make significant changes, we'll notify you in the app. Continued use of the app after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the state where the app's creators are located.
